Further erosion of your property rights. This is Much More Than an RV, Issue, The City of Napa wants to infringe more on what you can do with your property and is slowly taking away the rights to your land.

THIS IS A PUBLIC ANNOUNCMENT TO INFORM NAPA HOMEOWNERS, PROPERTY OWNERS AND NAPA CITIZENS OF THE RIGHTS THEY ARE ABOUT TO LOSE!

RV ORDINANCE DEBATE TO COMMENCE January 21, 2003 at 6:30 pm

Current Additional strick ordinances on the table (This apperantly comes from the Napa Police Department):

Ordinance would prohibit the following and this does not include what else may be added at the meeting:

1. Parking any vehicle or combination of vehicles that are more than 22 feet-feet in length, 8-feet wide, or 8 feet in height on a residential street. Question: Does this not mean that ALL RV's will not be able to park in the street?
2. Parking any unattached trailer on a residential street.
3. Fine for any violation would be $45.
4. 72 hour parking is permitted when parked adjacent to the owner's residence for the purpose of loading, unloading, or cleaning the vehicle in preparation for a trip or upon return of trip. Question?: This appears to only allow vehicles to park on the owners property for the prepared use of their RV as they are not allowed to park in the street (SEE # 1 & 2 Above) and also appears to be a work around way of Eroding our Property Rights by not allowing the good people of Napa to park their RV / Boat etc. on their hard earned, tax paid property after 72 hours? !!!

Due to the current situation in Napa of a limited and understaffed City that is unable to enforce the current codes properly (not by "complaint driven") and the approx. 13 spaces currently available in the environs of the City of Napa that can store an RV / Boat / Trailer etc, additional ordinances will only erode more of our property rights and take away needed safe storage areas for our RV's / Boats / Trailers etc.

Additional ordinances will also create more complaints by providing more "ammunition" for those to complain about. Additional complaints will take away additional City Resources, not allowing our Police and Code Enforcement department to do their main job, which is to protect, serve and insure public, health and safety issues -Not the use / abuse of City Power to reek havoc on an unsuspecting "neighbor".

OUR PROPOSAL TO PROVIDE A RELIEF VALVE for RV / Boat etc. owners & to allow the City of Napa to deal with more pressing issues!

SPIRIT OF THE CODE STAYS IN FORCE (That means no change to the Ordinances, thus the 72 hour parking rule on the street would remain unchanged)

SEPARATE APPLICATION REQUIRED

1. Separate application and fee for cities time and effort.

2. Owners will provide documents about the property, size and area of parking. Planning will review space to see if it appropriate for lot size or guidelines could be already stated so that code enforcement can merely follow those guidelines.

3. Owners will provide pictures of the specific item to be parked.

4. Owners will give signed testimony that the item to be parked is movable or driveable (in use during the year.)

5. Item must have a cover if it is a trailer or boat and the code could specifically state the color options so that it would blend with the neighborhood.

6. The size of the item could be determined by the allotted space.

7. No items can be stored to be worked on (such as cars, boats, rv’s, or parts)

CURRENT RV/ BOAT OWNER OPTIONS:

1. Comply with Napa Municipal Code(s) somehow and potentially await your "neighbor" finding something else to complain about (Ex: **Blight / Offensive / Regular Party Noise & GOD knows what etc) or;

2. Apply for a Variance: Cost $400 – $800. Problem, your neighbor(s) have a great influence on the outcome of whether you obtain a variance or not. Probable result / outcome of a variance request is that you will be out $400 - $800 and receive no variance just based on your neighbor(s) input or;

3. Put RV in storage at an average cost of $900 (uncovered) to $2,100 (covered) / year (include insurance and maintenance in this cost and we are looking at $1,500 - $3,000 or more) or;

4. Change the Law: To messy, costly, time consuming and possibly creates other potential problems or;

5. Sell your RV / Boat / Trailer / Motorcycle / Vintage Car / etc.!!! OR……..

6. COME TO THE CITY COUNCIL MEETING at 6:30 pm sharp to help all RV / Boat and property owners. Having your body at the City Council will have a much greater impact than sending a letter.

NOTE: I have done all that I can do handling this issue with City Planning and City Council, now it is up to all of you if you want your voice and rights heard! I look forward to seeing you at the Council Chambers.

If you want to keep your RV / Folding Camper / Camper Shell / Boat / Work Trailer / Motor Cycle / Wave Runner / Jet Skis / where it is currently and Your Property Rights intact,
I highly suggest you come to this meeting.

AS A NOTE, BASED ON MISINFORMATION BY OUR "FRIENDLY NEIGHBOR" THAT WE WANTED TO CHANGE CITY ORDINANCE CODES, WE WANT TO BE CLEAR THAT, WE HAVE NEVER SUGGESTED CHANGING ANY ORDINANCE. WE HAVE REQUESTED THAT THE CITY BE NON-BIASED AND FAIR TO RV / BOAT ETC. AND PROPERTY OWNERS.

I Know I Have Said Several Times, But If YOU DO NOT COME TO THE MEETING ON OCTOBER 15, 2002,
DON'T BE SURPRISED ONE DAY IF A "NEIGHBOR" COMES KNOCKING ON YOUR DOOR WITH THE USE OF CITY RESOURCES, TELLING YOU WHAT YOU CAN OR CANNOT DO WITH YOUR PROPERTY!
