We moved and live in Napa to enjoy the "Napa Life" of great
people, schools, work and giving back to Napa. We continue to enjoy
the Napa life and our friends, albeit the attack on our family and the
desire to take away our property, homeowner and RV / Boat rights.
Below is a brief, non-complete synopsis of why this issue is important
to us and should be to you too
We do not wish this on anyone and
we want to make sure that you and I "WE" keep our property
rights and the right to own and store our RV / Boats / Trailers on our
property.
My family moved to Napa and have been citizens of Napa since
1972.
In 1996 my wife and I moved into our home and we parked our boat
on our RV Pad that was built sometime around 1963. Many RV's, trailers,
boats and cars have parked on this pad since it was built.
All of a sudden, in August of 2001 we receive a letter from Code
Enforcement that we are in violation of a City Ordinance.
When requesting CED to explain why this came about, the following occurred
within a very short period of time:
A. Multiple letters of Violations and Threats,
B. Constant and Selective Scrutiny of our property,
C. Threats of pursuing / finding other violations by Susan Gildea of
CED
D. What we believe to be libelous statements made to our neighbors regarding
our intentions,
E. Threats by our "friendly neighbor" to contact the police
when our kids play on the sidewalk.
We did not ask for this fight. Our "neighbor" brought this
upon us and we are merely trying to protect your property rights and
ours. Below is just a sample of the correspondence and threats that
have occurred to date.

The following is a snapshot of the correspondence we have received to

1. August 1, 2001 Received
Letter From CED
A) Violation of Napa Municipal Code, Section 8.16.010 D20
B) Violation of Napa Municipal Code, Section 17.64.080
2. August 7, 2001 - Telephone call to CED RE: Aug. 1, 2001 letter
A) Requested name of person who filed complaint CED refused to
provide.
B) Requested why these codes are not being enforced CED reply
is they are "complaint compliant" .
C) Requested and extension to review the matter CED Denied.
D) Informed CED that I believe that someone is abusing the powers of
the city to harass us CED No comment was made.
3. August 7, 2001 Telephone call to John Yost RE: Aug.
1, 01 letter, Aug. 7, 01 phone call and requesting to understand the
code.
4. August 13, 2001 Letter Submitted to Tammy Dong CED explaining
that we believe we are not in violation and for clarification of possible
conflict in codes.
A) Requested code(s) in its entirety pertaining to the areas claimed
to be in violation.
5. August 14, 01 Telephone call to CED
(Susan Gildea) to confirm letter sent August 13, 2001 and
to discuss the discrepancies.
A) Susan Gildea of CED stated that the violation is valid and that there
is no discrepancy in codes. Upon attempting to clarify I began to read
Napa Municipal Code Section Code 17.04.020 located on page 464 "Setback,
front"
.lot line is normally the shorter of any lot lines
which border the street, only to be rudely interrupted and
B) Requested a copy of the actual codes violated in its entirety
CED Refused. Told to go get them myself. I explained that we already
had the codes
C) Requested clarification of code since many homes do not have a sidewalk
and a police officer further informed us that these type of codes are
enforced starting with a measurement from the curb side closest to the
street
i) CED Stated that the Police officer did not know what he was talking
about;
ii) CED refused to explain how they handle violations, for example -
homes located on West Lincoln whom do not have sidewalks.
iii) CED refused to discuss this matter any further as it was a "waste
of her time".
D) Property has pre-existing RV pad area: Explained
that this property has had a RV parking pad and driveway since the building
of the neighborhood in the early 60s. Furthermore, other RVs
have been parked here for many years prior to our purchasing the property.
CED refused to discuss this situation and began to abruptly interrupt
throughout the remaining conversation and ending the conversation with
a threat of "Now I am going to site you for your
RV pad and driveway".
E) Requested name of person filing complaint due to possible abusive
use of city - Refused
6. August 14, 2001 Letter to City Mayor
7. August 17, 2001 Letter to City Mayor
8. August 20, 2001 Received copy of Napa Municipal Code Sections
from CED which was no longer requested and which had already been explained
in detail by John Yost personally.
9. September 24, 2001 Letter to City Mayor
10. September 25, 2001
Letter from CED regarding Garbage Can issue 8.16.010 D19
- Prohibits the leaving or storage of any garbage can or refuse container
in the front or side yard area for more than 48 hours after collection
day, where such cans or containers are visible from a public street
or from adjoining property.
11. October 20, 2001 Police respond
to call regarding a disturbance from a B-Day Party.
12. October 24, 2001 Letter from planning department
13. November 7, 2001 Telephone call w/ John Yost. Explained that
we are in compliance with the set back and have informed CED of this
issue.
14. November 7, 2001 Receive letter from CED stating that we
are still in violation
